JUSTICE SUDHIR SINGH ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302/34 and 120B of the Indian Penal Code. Prosecution case, in brief, is that son of the informant was an employee in a wine shop and on his refusal to sell on credit, he was shot by fire arms and he died. It has been submitted on behalf of the petitioner that he is in custody since 1.3.2016. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner is not named in the F.I.R. After four months of the alleged occurrence, he has been made accused. Specific allegation of assault is against the persons named in the F.I.R., namely, Umesh Rai, Pradip Passi and brother of Umesh Rai.

On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like
