This is a petition for grant of regular bail for offence under Section 394 of the Indian Penal Code. The first information report of robbery is against unknown persons. Name of the petitioner transpired in the confessional statement of the co-accused. The petitioner is in custody since 18.07.2016 and submission is that the petitioner was not put on test identification parade during the investigation nor anything was recovered from the possession of the petitioner. Charge sheet has already been submitted in this case and similarly situated co-accused, Nitish Kumar @ Junglee, has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No. 5033 of 2017.
Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on
Patna High Court Cr.Misc. No.9806 of 2017 (2) dt.07-03-2017 2/2 furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Masaurhi P.S. Case No. 219 of 2016 to the satisfaction of the Subdivisional Judicial Magistrate, Masaurhi, Patna, or successor Court.
