Learned counsel for the informant is also present. The petitioner is apprehending his arrest in connection with Warishnagar P.S. Case NO. 46 of 2019 for the offence registered under Sections 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that though the petitioner is named in the first information report, the main allegation is against his son and not against the present petitioner. It is further submitted that no specific role has been attributed to the present petitioner, save and except, his presence. It is further submitted that there is land dispute between the parties.

Learned counsel for the informant submits that the petitioner and his son had attacked the deceased and therefore, the petitioner is not entitled to the privilege of anticipatory bail.

No.37693 of 2019(3) dt.23-08-2019 2/2 Considering the aforesaid facts and circumstances of the case and that no specific role has been attributed to the present petitioner, let the petitioner, above named, in the event of his arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur in connection with Warisnagar P.S. Case No. 46 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
