Criminal Miscellaneous No 20398 of 2017 Arising Out of PS.Case No. -23 Year- 2017 Thana -GAYA MUFFSIL District- GAYA ====================================================== Babloo Pandit, son of late Mangaru Pandit @ Late Mangru Prajapati, Resident of Village - Gere Road Krishnapuri Colony, Police Station - Mufassil, District - Gaya .... .... Petitioner/s

Versus

The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr Ram Kumar Singh, Advocate For the S t a t e : Mr Binod Kumar 3, APP ====================================================== CORAM: HONOURABLE MR JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-04-2017 Heard the parties.

Petitioner has earlier moved this Court for bail and this Court, vide order dated 06.03.2017 passed in Cr Misc No 10292 of 2017, has already rejected the prayer for bail with liberty to renew the same after completion of six months in judicial custody.

Petitioner has filed this application for bail afresh on the ground that his wife is suffering from cancer but, on query, he has admitted that six months time has already been granted by this Court for renewal of prayer for bail and the same has not been completed.

Considering this aspect of the matter, I am not inclined to interfere with the order dated 06.03.2017. Petitioner

Patna High Court Cr.Misc. No.20398 of 2017 (2) dt.26-04-2017 2/2 has always a right to move before the Court concerned for provisional bail if he so desires.

Accordingly, this application is disposed of. (Vinod Kumar Sinha, J) M.E.H./- U T
