JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-03-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 341, 323, 325, 452, 307, 379 and 504/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners has submitted that the occurrence took place out of a petty dispute between the neighbours. He submits that no offence under Section 307 of the Indian Penal Code is made out on the basis of the Fardbeyan of the informant. The petitioner no. 1 is wife of Pradeep Thakur, whereas, petitioner

Patna High Court Cr.Misc. No.43125 of 2014 (2) dt.20-03-2015 2/2 nos. 2 and 3 are sons of said Pradeep Thakur. It is stated in paragraph no. 3 of the application that petitioners are having no criminal antecedent.

In view of the above, let the petitioner nos. 1 to 3, abovenamed, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Hilsa (Nalanda), in connection with Telhara P.S. Case No. 94 of 2014, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
