The petitioner is languishing in custody since 07.03.2016 in connection with Rani Talab P.S. Case No. 51 of 2015 for the offences instituted under Sections 363 and 366(A)/34 of the IPC. The prosecution story, in brief, is that the daughter of the informant, namely, Duja Kumari, had gone out from the house without any information to the informant. When the informant and other family members searched her, then he got information that this petitioner, Madheshwar Mahto, his wife, Dilip Mali, Badari Mali and Suraj Mali in connivance with each other kidnapped the informant's daughter with intent to marry with her and the accused persons had also kidnapped the informant's son, Ravi Ranjan.

No.25343 of 2016 (3) dt.21-10-2016 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.03.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. He has got no criminal antecedent. He has falsely been implicated in the present case. The victims, the son and girl of the informant, have been examined under Section 164 Cr. P.C. The references of the same in paragraph nos. 54 and 55 of the case diary have been given. In paragraph no. 55 of the case diary, it has been stated by the victim girl that there was love affair and out of that she had eloped with this petitioner and they have already performed marriage.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Danapur, Patna, in connection with Rani Talab P.S. Case No. 51 of 2015.
