ANJANA MISHRA ORAL ORDER 27-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with Muzaffarpur Town P.S. Case No. 1049/2014 registered for the offences punishable under Sections 354, 307 and 506 of the Indian Penal Code and Sections 25(1-B) A, 26 of the Arms Act. Learned counsel for the petitioner submits that there was some love affair between the parties as a result of which, the allegation has been levelled against the petitioner. So far as question of recovery of revolver from the petitioner is concerned, learned counsel for the petitioner submits that the said recovery was not made from conscious possession of the petitioner rather it was said to have been recovered from the place of occurrence.

No.7018 of 2015 (3) dt.27-04-2015 Considering the aforementioned submission and also the fact that the petitioner is a young boy and is a student, let the petitioner, in the event of his arrest / surrender within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Town P.S. Case No. 1049 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
