The Petitioner seeks bail in Kankarbagh P.S. Case No. 710 of 2016 instituted for the offences under Section(s) 420,467,468,471, and 120B of the Indian Penal Code. It has been submitted that the petitioner, who is a lady, has merely carried the cheque for depositing in Bank on the advise of one Raj Mohan Tiwari, who is said to be the President of Karpi Gramin Samanway Society.
It has been submitted that cheque was drawn on Karpi Gramin Samanway Society and this lady was depositing the appropriate cheque in Account No. 20965369696. From the written report also it appears that informant has alleged that an
Patna High Court Cr.Misc. No.4516 of 2017 (2) dt.14-02-2017 attempt of fraud has taken place in the Branch of Allahabad Bank by the president and treasurer of Karpi Gramin Samanway Society by opening Account No. 20965369696. It is alleged in the written report that aforesaid cheque was presented and deposited in the aforesaid bank on 13.11.2016. The petitioner has stated in her statement under Section 164 Cr.P.C that she also gave her Voter I.D. and PAN Card when the informant demanded the same. In such circumstances, this petitioner who is a lady has merely gone to deposit the aforesaid cheque. She is neither the drawer of the cheque nor the beneficiary of the same.
In the facts and circumstances of the case, let the Petitioner who is a lady, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna in connection with Kankarbagh P.S. Case No. 710 of 2016, corresponding to G.R. No. 7626 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
