17-06-2015 Heard Sri Shekhar Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Sahpur P.S. Case No. 26 of 2015 registered for the offence under Section 307 & other allied sections of the Indian Penal Code, has prayed for grant of anticipatory bail.

Learned counsel for the petitioner submits that there was case and counter case. From the petitioner's side, F.I.R., vide Sahpur P.S. Case No. 27 of 2015, was registered on the same date for the offence under Section 307 & other allied sections of the Indian Penal Code. From the side of the petitioner, wife of brother of the petitioner had received serious injury. He submits that the injury, which was given by the petitioner, during examination was

Patna High Court Cr.Misc. No.20051 of 2015 (2) dt.17-06-2015 2/2 found to be simple in nature.

In view of the facts and circumstances, particularly; the fact that there was case and counter case as well as the injury, which is found to be simple in nature, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail. Let the petitioner namely Deo Kumar be enlarged on bail in the event of his arrest or surrender before the court below within a period of one month from today on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Anil Kumar Thakur, learned Judicial Magistrate, Danapur/concerned court in connection with Sahpur P.S. Case No. 26 of 2015 corresponding to G.R. No. 537 of 2015, subject to condition, as laid down under Section 438(2) of the Cr.P.C.
