The petitioner has been in custody since 13.12.2017 in connection with Sheikhpura (Kuthumbha O.P.) P.S. Case No. 316/2017 registered for the offences punishable under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is no specific allegation against the petitioner nor is there any cogent material available in the case diary. It is further submitted that only on the confessional statement made before the police by a co-accused, the petitioner is facing prosecution. In view of the aforementioned facts and circumstances, and also because save and except this case, the petitioner is also having two other cases against him and since no recovery has been made from him, let the petitioner above named,

Patna High Court Cr.Misc. No.18492 of 2018 (3) dt.26-04-2018 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhpura (Kuthumbha O.P.) P.S. Case No. 316/2017.
