JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offence punishable under Sections 20 and 22 of Narcotics, Drugs and Psychotropic Substances Act, 1985.

As per prosecution case, 143 small packets of Heroine have been recovered from the house of co-accused Komal Yadav. It is alleged that Komal Yadav purchased the heroine from this petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that this petitioner has been made accused in this case only on the basis of confessional statement of co-accused Komal Yadav whereas, nothing has been recovered from his conscious possession. Petitioner has got no criminal antecedent.

No.39547 of 2022(2) dt.23-11-2022 2/2 Considering the fact that huge amount of heroine has been recovered from co-accused Komal Yadav, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
