The petitioner is languishing in jail since 11.5.2016 in a case registered for the offence punishable under section 20(b) of the N.D.P.S.Act.
From the shop of the petitioner 150 grams of Ganja was recovered.
It is submitted by the learned counsel for the petitioner that the weight has been recorded on speculation and even assuming recovery it is of small quantity. Statement has been made in paragraph 3 of the application that the petitioner has no criminal antecedent.
Learned counsel for the State has not disputed the fact of small quantity of recovery.
Patna High Court Cr.Misc. No.26116 of 2016 (2) dt.24-06-2016 Considering the aforesaid fact, let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge cum Special Judge, Madhepura in Special Case No. 5/2016 arising out of Complaint Case No. 51(7)/2016.
