The petitioner seeks bail in Bhawanipur P.S. Case No. 135 of 2015 registered under Sections 147, 148, 149, 341, 323, 324, 307, 447, 336 and 504 of the Indian Penal Code. The informant alleged that the accused persons came to his field and threw chili powder in his eyes. Mukesh Mandal (petitioner) is alleged to have assaulted Manoj Mandal (informant) and Jawahal Mandal.

Leanred counsel for the petitioner submits that the injuries on the persons of Manoj Mandal and Jawahar Mandal are simple in nature. There is a land dispute between the parties and for that the petitioner is in jail since 19.12.2016. Considering the facts aforesaid that on account of

Patna High Court Cr.Misc. No.19130 of 2017 (3) dt.09-05-2017 2/2 assault made by the petitioner, Manoj Mandal and Jawahar Mandal received simple injury and the petitioner has remained in jail for more than 41⁄2 months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Purnea in connection with Bhawanipur P.S. Case No. 135 of 2015.
