====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 14-09-2016 Learned counsel for the petitioner is permitted to make correction in the first paragraph of the bail petition with regard to Section of the Indian Penal Code.

Heard both sides.

The petitioner apprehends his arrest in Araria P.S. Case No. 642 of 2015 registered for the offences punishable under Sections 399, 402 and 414 of the Indian Penal Code. The police after having received information that some criminals had assembled near Mira Talkies for committing dacoity raided the place and apprehended one Md. Bablu. Md. Bablu disclosed name of the petitioner and others. On search of Md. Bablu one mobile, motorcycle and dagger were recovered from his possession.

Patna High Court Cr.Misc. No.30135 of 2016 (2) dt.14-09-2016 2/2 Learned counsel for the petitioner submits that Md. Bablu @ Babloo who was apprehended on the spot has already been enlarged on bail vide order passed in Cr. Misc. No. 7423 of 2016 on 16.02.2016. Co-accused Tofi @ Toffee @ Akram Sahzad @ Akram Shahzad has been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 15715 of 2016 on 03.05.2016. The petitioner has got no criminal antecedent.

Considering the facts aforesaid and the fact that case of the petitioner stands on the same footing as that of Tofi @ Toffee @ Akram Sahzad @ Akram Shahzad and the petitioner has got no criminal antecedent, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in Araria P.S. Case No. 642 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
