This is a petition for grant of regular bail for offences under Sections 504, 506 and 376 of the Indian Penal Code.

The informant has got divorce from her husband and was living along with the petitioner. Subsequently, she developed intimacy with the petitioner and the allegation is that the petitioner posed himself as an unmarried person and has persuaded the informant for physical relation. Thereafter, the informant came to know that the petitioner is already a married person. Submission of the petitioner is that the matter is of consensual sex, even if allegation is correct, the offence of cheating is made out.

Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on

Patna High Court Cr.Misc. No.9786 of 2017 (2) dt.07-03-2017 2/2 furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Nagar Sahayak (Katihar) P.S. Case No. 671 of 2012 to the satisfaction of the Chief Judicial Magistrate, Katihar, or successor Court.
