The petitioner seeks bail in connection with Darpa P.S. Case No. 22 of 2017 for offences punishable under Sections 364/34 of the Indian Penal Code.
The case of the prosecution is that the informant, namely Chandar Sahani's daughter namely Sohari Devi was married with one Suresh Sahani i.e. the son of the petitioner herein nine years ago. On 29.3.2017 when the informant had gone to Sasural of his daughter, then the petitioner had stated that after some altercation the victim girl had left the house and since then the victim girl is traceless. It has been further alleged that the victim girl is still traceless and the son of the petitioner has solemnized second marriage.

No.21030 of 2018 (4) dt.17-05-2018 2/2 The learned counsel for the petitioner submits that the main allegation is against his son who is already in custody, hence no prejudice would be caused in case the petitioner who is an old person is granted bail. It is stated that the petitioner is in custody since 26.09.2017 and is having a clean antecedent. Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Motihari, East Champaran in connection with Darpa P.S.
