JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 332, 353, 436, 427, 120B, 504 and 506 of the Indian Penal Code and Sections 3(I) and 4 of The Prevention of Damage to Public Property Act.

The prosecution case is that a mob of 300-400 people, made protest against the assault made by the S.S.B. constable to a person, consequently mob attacked the police station premises and put the vehicle on fire when the police resorted to fire. It is submitted by learned counsel for the petitioner that the accusation is against the mob. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

No.23102 of 2015 (2) dt.13-07-2015 2/2 Considering the accusation against the mob, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Birpur in connection with Kunauli P.S. Case No. 46 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
