JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-147, 149, 341, 323, 325, 333, 353, 427, 504, 188, 337, 171© and 171(E) of the Indian Penal Code and 47(a) 61 of Bihar Excise (Amendment) Act, 2016 and 3(I)(X) of S.C./S.T. Act. The allegation against the petitioner is that he arranged a feast at his door and invited several persons, who were voters in Panchayat Election as the wife of the petitioner was candidate of Mukhiya in the recent Panchayat Election. The petitioner and his supporters were distributing cash and liquor to the voters and having got aforesaid information, police party as well as higher

Patna High Court Cr.Misc. No.25841 of 2016 (2) dt.24-06-2016 2/2 officials including local media, reached there and made attempt to arrest some persons but the petitioner and his supporters became furious and attacked on the police. Anyhow, two persons were arrested whereas; the petitioner and some others managed to escape from there. The informant claims that country-made liquor was also recovered from there.

Contention on behalf of the petitioner is that the present case has been lodged at the behest of political enemies of the petitioner and as a matter of fact, no liquor was recovered either from possession of the petitioner or from his house and that is the reason, the police officer did not prepare any seizure list. Moreover, petitioner is a government teacher and he is languishing in jail custody since long without having any criminal antecedent. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Alamnagar P.S. Case No. 59 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Udakishunganj, District-Madhepura.
