The petitioner seeks bail in Harsidhi P.S. Case No. 335 of 2016, registered for the offence punishable under Section 414 of the Indian Penal Code.

The police on secret information that some criminals had assembled with stolen motorcycle, went near Bhada bridge, but seeing the police the petitioner started fleeing away. The petitioner was apprehended on chase and from near bridge one motorcycle was recovered. The petitioner is said to have disclosed that the aforesaid motorcycle is stolen one.

Learned counsel for the petitioner submits that the petitioner has not committed any theft. The recovery is not made from the conscious possession of the petitioner. The petitioner is

Patna High Court Cr.Misc. No.15337 of 2017 (2) dt.19-04-2017 2/2 in jail since 20.10.2016. The petitioner has already remained in jail for six months.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-7, East Champaran, Motihari in Harsidhi P.S. Case No. 335 of 2016.
