The Interlocutory Application has been filed for amendment in the relief prayed for in paragraph no. 1 of the restoration application seeking restoration of I.A.No.553 of 2014 and 554 of 2014 also along with LPA No.128 of 2014. On a consideration of the facts and circumstances of the
Patna High Court MJC No.1027 of 2015 (5) dt.29-01-2016 2/2 case, prayer for amendment is allowed.
I.A.No.707 of 2016 is, accordingly, disposed of. Upon hearing learned counsel for the petitioners and learned counsel for the opposite parties, LPA No. 128 of 2014 and I.A.No.553 of 2014 and 554 of 2014 are all directed to be restored to their respective original files subject to the condition that the petitioners shall comply with the order dated 08.09.2014 passed in LPA No. 128 of 2014 within a period of three weeks from today if not already, complied with.
The restoration application is, accordingly, allowed subject to the aforesaid condition.
