JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-06-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report but according to the prosecution case itself, it were co-accused Wakil Yadav, Raju Yadav and Kameshwer Yadav, who assaulted the deceased. So far as petitioner no. 1 is concerned, it is alleged that when one Upendra came to rescue the deceased, he was assaulted by the petitioner no.1 and other co-accused. Similarly, the wife of the informant was assaulted by petitioner no. 2 and other coaccused. Taking note of this fact that petitioners did not even touch the body of the deceased, let the petitioners, above named,

Patna High Court Cr.Misc. No.25921 of 2016 (2) dt.24-06-2016 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Sidhwalia P.S.Case No. 15 of 2016.
