2. The petitioner apprehends his arrest for the offences alleged under Sections 419, 420 and 188 of the Indian Penal Code, registered in connection with Konch P.S.Case No. 18 of 2023.

3. A team of the Health Department raided the Magadh Nursing Home, Gaya, which is alleged to be run by the petitioner without having a licence.

4. The learned counsel for the petitioner has submitted that he is innocent and has falsely been implicated in this case. He has no concern with the alleged nursing home. When the raid was conducted, only one person was found who

Patna High Court CR. MISC. No.39677 of 2023(2) dt.02-08-2023 2/2 apprised himself as the staff of that nursing home and he also apprised the medical team that the petitioner is the proprietor of that nursing home. He has submitted further that the petitioner is a person of clean antecedent.

5. Considering the above facts and circumstances, as also the fact that the petitioner himself does not claim his proprietary right over that nursing home, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Gaya in connection with Konch P.S.Case No. 18 of 2023, subject to the conditions as laid down under Section 438(2) Cr. P.C.
