This revision application has been filed under Section 53 of the Juvenile Justice (Care and Protection of Children) Act, 2000, against the order dated 06.02.2018 passed by the learned Additional Sessions Judge 1st, Patna in Criminal Appeal No 08 of 2018 by which the Sessions Judge reject Cri. Appeal No. 08 of 2018 preferred against the order dated 14.02.2017 passed by J.J.B., Patna in connection with J.J.B. Case No. 579 of 2017 arising out of Pirbohor P.S. Case No. 603 of 2017 under Section 290 of the IPC and under Section 20/22 of N.D.P.S. Act . In the written report, it is alleged that four packets, each containing one gram smack and one mobile set is said to be recovered from possession of the petitioner. Learned counsel for
Patna High Court CR. REV. No.278 of 2018 (4) dt.24-05-2018 2/2 the petitioner has submitted that petitioner had been declared juvenile by the Juvenile Justice Board vide order dated 26.11.2017/ 27.11.2017 and his age has been assessed about 14 years. One of the co-accused has been granted regular bail vide order dated 07.02.2018 passed in Cri. Misc. No. 1713 of 2018 by another co-ordinate Bench of this Court. He is in custody since 22.10.2017.
Considering the entire facts and circumstances, aforesaid, let the petitioner, above named be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each in connection J.J.B. Case No. 579 of 2017 arising out of Pirbohore P.S. Case No. 603 of 2017 to the satisfaction of the Juvenile Justice Board, Patna subject to the conditions that both the bailors shall be close relatives of the petitioner and one of them would be the mother of the petitioner.
