JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier prayer for bail of the petitioner was rejected by this court vide order dated 04-11-2015 passed in Cr. Misc. No. 36673 of 2015 and the trial court has reported that uptill now, only one prosecution witness could be examined.

The petitioner is languishing in jail custody since 0604-2015 and prior to institution of the present case, the petitioner had not been made accused in the case of kidnapping. Moreover, some co-accused, having more or less similar allegation, have already been granted privilege of either regular bail or anticipatory bail.

Considering the above-said facts and circumstances of

Patna High Court Cr.Misc. No.32550 of 2016 (3) dt.19-10-2016 2/2 the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bela P.S. Case No. 21 of 2014 corresponding to Sessions Trial No. 349 of 2015 to the satisfaction of Learned Additional Sessions Judge-Ist, Sitamarhi.
