2. The petitioner seeks bail in connection with Kalyanpur P.S. Case No. 28 of 2025 registered for the offences under Sections 103(1), 238 and 3(5) of the Bharatiya Nyaya Sanhita.
3. The petitioner is named in the F.I.R. and is in custody since 21.01.2025.
4. As per FIR, informant, who is a chowkidar namely Hemchandra Tiwari (No.1/5) received information that one dead body was kept hidden in a bush near 14-Ali bridge, which is of 15 year old girl and after recovery of dead
Patna High Court CR. MISC. No.43463 of 2025(2) dt.25-08-2025 2/3 body informant came to know that dead body was of Amisha Kumari of Sisawa Kharar Village, District East Champaran. It was alleged that parents, brother and uncle of the deceased committed present murder.
5. Learned counsel appearing on behalf of the petitioner submitted that implication of petitioner in the present case is based upon suspicious information received from unknown villagers. It is submitted that petitioner is the father of the deceased and as deceased was mentally challenged, therefore, she was in habit to leave home frequently and on one such occasion the present occurrence took place by unknown persons. Petitioner being father was also in search of her missing daughter but in meantime he was implicated. It is submitted that dead body was not recovered from the house of the petitioner rather it was recovered from an far isolated place. While concluding the argument it is submitted that petitioner found involved in one more case, where he is on bail and moreover, investigation of this case has already completed, and as such, there is no chance of tampering with the evidence.

6. Learned APP appearing on behalf of the State, opposes the prayer for bail.

In view of aforesaid factual submission and by taking note of fact as except suspicion arising out of information received from unknown co-villagers nothing incriminating appears during the course of investigation against petitioner, as to connect him with the present crime in question, coupled with the fact as petitioner remains in custody since 21.01.2025, accordingly above named petitioner, is directed to be released on bail in connection with Kalyanpur P.S. Case No. 28 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari/concerned court, subject to the conditions as mentioned under Section 480(3) of the B.N.S.S.
