Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the fardbeyan nor in the further statement of the informant and from perusal of the impugned order, it appears that name of petitioner came in this case in the statement of the witness Sudhir Choudhary. The murder of informant's husband took place in front of house of the aforesaid witness Sudhir Choudhary but the informant specifically claims that it was co-accused Kanhaiya Choudhary, who shot fire on her husband. Moreover having more or less similar allegation, one co-accused Subham Kumar has already been granted privilege

Patna High Court Cr.Misc. No.26278 of 2016 (2) dt.11-07-2016 2/2 of bail by a co-ordinate Bench of this Court. Petitioner is in jail custody since 09.02.2016 without having any criminal antecedent. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Begusarai in connection with Bachhwara P.S.Case No. 03 of 2015.
