1. Heard learned counsel for the petitioner and learned APP for the State.
2. Petitioner seeks regular bail in connection with Bairgania P.S. Case No. 270 of 2022, dated 21.09.2022 registered for the offence punishable under Section 379 of the Indian Penal Code.
3. The main submissions advanced by learned counsel Mr. Ashok Kumar Jha appearing for the petitioner are that the alleged stolen motorcycle was not recovered from the possession of this petitioner rather the same was noticed by the informant being kept in the premises of the police station and two days after the recovery of the motorcycle, the FIR was lodged and the petitioner has been falsely roped in this case and
Patna High Court CR. MISC. No.43639 of 2023(2) dt.26-07-2023 2/2 he has been languishing in jail since 21.09.2022 and against him there is criminal antecedent of one case in which he is on bail.
4. Learned APP Mr. Braj Kishore Pd. appearing for the State has opposed the prayer for bail.
5. Having regard to the facts and circumstances of this case and considering the above submissions, this Court is inclined to accept the petitioner's prayer for bail. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Bairgania P.S.
