JUSTICE SANJAY PRIYA ORAL ORDER 23-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Khagaria (Muffasil) P.S. Case No. 472 of 2016 instituted for the offence under Sections 25(1-B)A, 26 and 35 of the Arms Act.

It has been submitted that the petitioner is in custody since 1.8.2016. There is no independent or eye witness of the case. From the seizure list it appears that one country made pistol along with six live cartridges of .315 bore and a Vindoliya was recovered from the possession of the petitioner. It has been submitted that charge sheet has already been submitted in the case. The petitioner is on bail in another case for the Arms Act.

Keeping in view the period spent by the petitioner in custody, the

Patna High Court Cr.Misc. No.5646 of 2017 (2) dt.23-02-2017 2/2 prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Muffasil) P.S. Case No. 472 of 2016, G.R. No. 1614 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner. The petitioner will cooperate in trial and will remain present on each and every date of trial. Any two subsequent defaults will result in cancellation of bail bonds in the court below.
