2. Heard Mr. Satya Prakash Parasar, learned counsel for the petitioner and Ms. Pushpa Sinha, learned Additional Public Prosecutor for the State.

3. Petitioner seeks bail who is in custody since 24.01.2026 in connection with Amdanda P.S. Case No. 124 of 2025, F.I.R. dated 15.12.2025 for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 352, 351(2) and 3(5) of the BNS, 2023.

4. According to prosecution case, all the accused persons including this petitioner have assaulted the informant and his family members over a previous dispute.

5. Learned counsel for the petitioner submits that

The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR. In fact, informant and petitioner are agnates to each other and due to some previous dispute the present occurrence has taken place. Although there is specific allegation against the petitioner that he has assaulted to the informant who happens to be his brother, due to which he received injury which is grievous in nature. He further submits that due to fracture in his hand, the injury appears to be grievous in nature. Apart from that it appears from the FIR that the date of occurrence as alleged in the FIR is 19.11.

2025 but the present FIR has been instituted on 14.12.2025 i.e. after delay of 25 days afterthought only to falsely implicate the petitioner. He further submits that the police after investigation submitted the charge sheet against the petitioner. The petitioner is in custody since 24.01.2026.

6. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner.

7. Considering the aforesaid facts and circumstances that the petitioner has clean antecedent, there is case and counter case between the parties as well as period of custody, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court CR. MISC. No.39894 of 2026(2) dt.25-06-2026 3/3 bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XIX, Bhagalpur in connection with Amdanda P.S. Case No. 124 of 2025, subject to the following conditions:- i. Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below. ii. If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.

iii. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification. (Rajesh Kumar Verma, J) Vanisha/- U T
