JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Saraiya (Jaitpur O.P.) P.S. Case No. 19/2015, registered under Sections 498(A), 307 and 326/34 of the Indian Penal Code. The allegation of informant Azmeri Khatoon is that she was being tortured by her husband Md. Hasim and her fatherin-law Md. Salauddin (Petitioner) due to non-fulfillment of demand of motorcycle. On 26.12.2014, she was at her house and at that time her father-in-law sprinkling kerosene oil and her husband Md. Hasim put fire lighting the matches stick due to which she sustained burn injury. On raising alarm, she was taken for treatment and later on she died in course of treatment.

Patna High Court Cr.Misc. No.17796 of 2017 (3) dt.04-05-2017 Submission is that the parents of the deceased have stated that the petitioner, who is father-in-law of the deceased, has no hand in causing burn injury.

Having considered the nature of allegation made by the informant/deceased against her father-in-law, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. (Rajendra Kumar Mishra, J.) Rakhi U T
