The petitioner seeks regular bail in connection with Sour Bazar (Patarghat O.P.) PS case no. 428 of 2017 instituted for the offences punishable under Section 392 of Indian Penal Code. The allegation is regarding the accused persons having apprehended the informant, assaulted him and having snatched his motorcycle and mobile phone.

The learned counsel for the petitioner submits that the petitioner has been remanded in the present case on 25.07.2017 from another case on the basis of his confessional statement and infact, neither anything has been recovered from his possession nor he was arrested from the spot. It is further

No.23878 of 2018 (6) dt.29-05-2018 2/2 submitted that the petitioner has filed a supplementary affidavit wherein, it has been stated that the petitioner is an accused in four other cases, however he is on bail in three cases. Lastly, it is submitted that the petitioner is languishing in custody since 31.10.2017.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Sour Bazar (Patarghat O.P.) PS case no. 428 of 2017. It is further directed that the petitioner shall mark his presence before the officer-in-charge of the concerned police station at 10 am on every Monday and in case of failure to do so on two consecutive occasions, the present privilege of bail shall stand cancelled automatically.
