JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-06-2016 The petitioner is languishing in custody since 20.12.2015 in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-B)a, 26 of the Arms Act and Sections, 20, 22 of the N.D.P.S Act.

On the information that miscreants are preparing to commit dacoity, raid was laid when from the possession of co-accused Nitesh Kumar 2 1⁄2 KG of Ganja was recovered. From the possession of the petitioner one automatic pistol loaded with five cartridges were recovered. It is submitted by learned counsel for the petitioner that petitioner is also accused in Bidupur P.S. Case No. 207 of 2015 registered under Section 395 I.P.C wherein he is on bail. A statement to that effect has been made in para 3 of the petition. Moreover the investigation has already concluded. Learned A.P.P has not controverted the contention of learned counsel for the petitioner.

No.27153 of 2016 (2) dt.30-06-2016 2/2 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 525 of 2015.
