This is a petition for grant of regular bail for offences under Sections 341, 323, 307, 427 and 504/34 of the Indian Penal Code.

There is allegation against the petitioner and others that for property dispute they committed assault to one Dhirendra Prasad, who died during course of treatment. Co-accused, Dinesh Prasad Singh, has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No. 48580 of 2016, after perusal of the case diary.

Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Shambhugunj P.S. Case No. 78 of 2016 to the

Patna High Court Cr.Misc. No.13258 of 2017 (2) dt.22-03-2017 2/2 satisfaction of the Chief Judicial Magistrate, Banka, or successor Court with the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
