JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner as well as learned APP for the State.
On getting confidential information, a raid was conducted in the house of Ram Saran Paswan, jointly occupied by other members, during course thereof, it has further been specified that ten litres of Mahua wine was seized from a room belonging to Rajiv Paswan, one of the sons Ram Saran Paswan. During midst thereof, petitioner came out from his house whereupon he was apprehended. It has also been disclosed that on his confessional statement, raw Mahua was found concealed beneath weed which was destroyed. Furthermore, from the seizure list, it is evident that there happens to be no presence of petitioner over the same. Petitioner happens to be under custody since

Accordingly, petitioner, Rahul Paswan is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Alauli PS Case No. 110/2016, but considering the criminal antecedents of the petitioner, being an accused of Excise case of the year 2015, one of the bailors should be a government servant who will give an undertaking that, in case, petitioner is found indulged in such kind of activity, then in that event, amount of his bail bond will be forfeited.
