Heard learned respective counsels as well as learned Additional Public Prosecutor.

Instant complaint petition has been filed on account of non honouring of the cheques issued by the petitioner in favour of opposite party No.2/ complainant in lieu of price of wheat. Learned counsel for the opposite party No.2 has admitted receipt of Rs. 1, 28,500/-. Side by side supplementary affidavit has also been filed on behalf of the petitioner on that very score.

In the aforesaid facts and circumstances of the case, in the event of arrest or surrender within four weeks from the date of

No.44175 of 2014 (4) dt.02-07-2015 2/2 receipt/ production of a copy of this order the petitioner, namely, Sita Ram Yadav shall be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri A. K. Mani, learned Judicial Magistrate, 1st class, Saharsa/ or successor court in connection with complaint case No. 25 of 2013, subject to condition as laid down under section 438(2) of the Cr. P. C.
