JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Terhagacch P.S. Case No. 48 of 2014 registered for the offences punishable under Sections 302, 201 of the Indian Penal Code. The case was registered against unknown and in course of investigation, some witnesses stated that deceased used to tease the petitioner's sister and that is why petitioner and his other family members committed the murder of the deceased inside their house and threw the dead body but except suspicion, there appears to be nothing against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is
Patna High Court Cr.Misc. No.11687 of 2015 (3) dt.28-04-2015 allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in Terhagacch P.S. Case No. 48 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C. and furthermore, he shall cooperate with the investigating officer in course of investigation and shall make available himself before the investigating officer, whenever he is called by the concerned investigating officer.
