The petitioner is in custody since 12.02.2018 in connection with Balrampur (Telta) P.S. Case No. 14 of 2018 for the offence registered under Sections 302 of the Indian Penal Code.

Learned counsel for the petitioner submits that the first information report is against unknown persons but only on the basis of strong suspicion during the course of investigation, the petitioner's name has been dragneted in the present prosecution. It is further submitted that the learned Sessions Judge rejected the bail of the petitioner merely depending on the post-mortem report which is a document admitted but nothing is there to show that the petitioner has any role in the alleged occurrence.

Patna High Court Cr.Misc. No.18509 of 2018 (3) dt.27-04-2018 Learned counsel appearing on behalf of the State after perusal of the case diary submits that save and except the strong suspicion, there is no further material in the case diary. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate- VI, Katihar in connection with Balrampur (Telta) P.S. Case No. 14 of 2018.
