JUSTICE SUDHIR SINGH ORAL ORDER 25-06-2015 The petitioners are apprehending their arrest in connection with Pirpainty PS case No. 63/2015 for the offence under section 302/34 of the Indian Penal Code. Heard learned counsel for the petitioners and the State. The prosecution story, in brief, is that the petitioners and other co-accused named in the FIR in furtherance of common intention killed the daughter of the informant namely Lakho Devi. It is alleged that the deceased daughter of the informant was married with co-accused Binod Yadav.

It has been submitted on behalf of the petitioners that the petitioners have no criminal antecedent. Further, it has been submitted that petitioner Nos. 1 and 3 are brother-in-law of the

Patna High Court Cr.Misc. No.20584 of 2015 (2) dt.25-06-2015 2/2 deceased, petitioner No.2 is father-in-law and petitioner No.4 is brother-in-law of the deceased. Further, it has been submitted that there is no direct or indirect evidence against the petitioners. Further, it has been submitted that on behalf of the petitioners they are separate in mess and property with the husband of the deceased.

On behalf of the State it has been submitted that the petitioners are named in the first information report. Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Bhagalpur in connection with Pirpainty PS case No. 63/15, subject to condition as laid down under section 438(2) of the Cr. P.C.
