JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Bishanpur P.S. Case No. 113 of 2016, registered under Section 341, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that on 03.12.2016, Naushad Ali Khan, brother of the informant, along with his friend were coming to his house after closing the shop, then three persons riding on a motorcycle reached near the brother of the informant and out of three miscreants, on Tara shot fire through pistol causing injury to Naushad Ali Khan, brother of the informant. Thereafter, brother of the informant rushed to DMCH for treatment.

Further submission is that the apprehended person Tara disclosed the name of petitioner in his confessional statement. Further submission is that petitioner has no criminal antecedent is in custody since 20.12.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) two sureties of the like amount each to the satisfaction of the ACJM-VII, Darbhanga in connection with Bishanpur P.S. Case No. 113 of 2016.
