JUSTICE SUDHIR SINGH ORAL ORDER 02-07-2015 The petitioners are apprehending their arrest in connection with Manjhi P.S. Case No. 44 of 2015 for the offences instituted under Sections 147, 148, 149, 341, 323, 324, 326, 307 and 379 of the Indian Penal Code.
Heard learned counsel for the petitioners and the State. The prosecution story, in brief, is that the informant has taken a pond on settlement for fishing in which he heard that the accused persons including these petitioners were fishing. On such information, he alongwith Lankesh Singh rushed to the P.O. pond where he objected the accused persons from fishing on which they started firing indiscriminately by rifle and country made pistol.
Patna High Court Cr.Misc. No.20673 of 2015 (2) dt.02-07-2015 2 / 3 Anil Ram fired at Lankesh Singh with country made pistol which hit on his right chest. Bhola Bind fired from country made pistol which hit on the head of the informant. Both of the them fell down during fleeing away. Then Rameshwar Ram fired which hit on his back. Sonu Ram, Pappu Ram, Tuntun Bind and Munna Bind also took out of Rs. 4000/- from his pocket. Due to timely arrival of villagers they could be saved and the accused persons taking two quintals fish fled away making firing.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. It is further submitted that there is a case and counter case. Counter case is Annexure-2 to the present application. It is further submitted that specific allegation of assault is alleged against Anil Ram, Bhola Bind and Rameshwar Ram. So far as petitioners are concerned, general and omnibus allegation has been made against them. On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts, let the above named petitioners, be released on bail in the event of their arrest or surrender before the learned court below within a period of four weeks from today in connection with Manjhi P.S. Case No. 44 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each
