JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406, 420, 468, 470, 471 and 477A of the Indian Penal Code.
The prosecution case is that the cashier Dharmendra Kumar, the Branch Manager, S.B.I., Ghosi, Ajeet Singh along with the petitioner being the Proprietor of Prince Enterprises in connivance with each other withdrew `35,000/- of K.C.C. loan and `1,00,000/- loan for power tiller total `1,35,000/- in the name of the informant Satya Narayan Singh by forging signature of the informant and transferred the said amount in the account of the petitioner.
It is submitted by learned counsel for the petitioner that the amount was transferred in the account of the petitioner under
Patna High Court Cr.Misc. No.22530 of 2015 (2) dt.07-07-2015 2/2 bona fide mistake but now the total amount has been transferred in the account of the informant. Moreover, the cashier of the bank has been granted anticipatory bail vide Cr. Misc. No. 1025 of 2015.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jehanabad in connection with Ghosi P.S. Case No. 271 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
The bail bonds of the petitioner shall be accepted by the learned court below on verification of the fact that the amount has actually been transferred in the account of the informant. (Dinesh Kumar Singh, J) Amrendra/- U T
