JUSTICE ARUN KUMAR ORAL ORDER 05-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Bhagwan Bazar P.S.Case No. 103 of 2017 registered under Sections 392 of the Indian Penal Code. Allegation in brief is that some unknown miscreants robbed the informant looted Rs. 3500/-, his mobile and other documents.

Submission is that FIR is against unknown, neither any incriminating material has been recovered from his possession nor he was put on TIP for identification by the informant and merely on the basis of statement of some witnesses and on confessional statement of accused Kanishk Kumar, petitioner has been implicated in this case but Kanishk Kumar has been granted by the court below itself and petitioner has been denied

Patna High Court Cr.Misc. No.20981 of 2018(4) dt.05-07-2018 2/2 bail merely on account of his criminal antecedent. Having considered the aforesaid facts and circumstances, in particular, in absence of any recovery or not putting him on T.I.P., the petitioner, namely, Kundan Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Chapra, Saran in connection with Bhagwan Bazar P.S. Case No. 103 of 2017.
