The petitioner seeks bail in a case registered for offences punishable under Sections 364, 302, 379/34 of the Indian Penal Code.
It is submitted on behalf of the petitioner that the First Information Report has been lodged against unknown persons for abduction and murder of Munshi and Guard of a brick kiln. Three persons, namely, Madhuri Mushar, Ram Pyare Mushar and Ram Singhasan Mushar were made accused on the basis of confessional statement of Pramod Mushar. Thereafter, the aforesaid three persons including the petitioner have also been implicated. It is contended that besides the confessional
Patna High Court Cr.Misc. No.26648 of 2016 (2) dt.15-07-2016 2/2 statement of co-accused there is nothing against the petitioner and no recovery has been made from him. The aforesaid three persons as well as co-accused Nirmal Choudhary and Shankar Bind have already been granted bail by different coordinate benches of this court vide Annexure 2 series. Considering the facts and circumstances of the case, the petitioner, namely, Raj Bansh Paneri @ Rajbansh Chourasia is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in connection with Kudra P.S. Case No. 245 of 2015.
