2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30(a), 38((2) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, 63 litres foreign liquor has been recovered near canal.

4. Learned counsel for the petitioner submits that recovery has been made from an open place. No incriminating material has been recovered from the conscious possession of the petitioner and petitioner is not concerned with the alleged recovery. Petitioner claims clean antecedent.

5. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his

No.42234 of 2024(2) dt.18-07-2024 2/2 arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Court No. 2, East Champaran, Motihari in connection with Excise P.
