The petitioners are apprehending arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code Section 11 (d) (f) of the Prevention of Cruelty to Animals Act, 1960.

Accusation is of smuggling the animals in a pick up van and the petitioners being the driver and owner of the alleged vehicle.

It is submitted by learned counsel for the petitioners that the alleged vehicle is public carrier and there is nothing to suggest that the seized animals were stolen one. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

No.11265 of 2015 (2) dt.28-04-2015 2/2 Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Gopalganj in connection with Gopalpur P.S. Case No.103 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. The bail bonds of the petitioners will be accepted on filing of the affidavit by the petitioners before the learned court below to the effect that they will regularly co-operate in the investigation. Non-cooperation in the investigation by the petitioners will give liberty to the learned court below to cancel the bail bonds of the petitioners.
