JUSTICE BIRENDRA KUMAR ORAL ORDER 25-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 147/148/149 /448 /323 /504 / 302/325/342 of the Indian Penal Code.
On the order of this petitioner other co-accused assaulted to deceased Putur Sao as a result whereof Putur Sao, aged about 70 years, died.
Submission of the petitioner is that both are agnates and for trivial dispute earlier criminal case was also there between the parties.
Considering the background and nature of allegation, let petitioner, above named, be enlarged on bail on
Patna High Court Cr.Misc. No.18495 of 2017 (2) dt.25-04-2017 2/2 furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Sherghati, Gaya/Successor Court, in connection with Imamganj P.S. Case No.56 of 2003, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
