JUSTICE SUDHIR SINGH ORAL ORDER 09-07-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 366(A) and 34 of the Indian Penal Code. The prosecution story, in brief, is that on 2.7.2014, the informant got information that his daughter Lavely Kumari aged about 16 had gone to market with her Mammi at Makhdumpur from where she was kidnapped by the petitioners along with other co-accused persons named in the FIR.
It has been submitted on behalf of the petitioners that the main allegation is against Manjit Singh. As far as petitioner is concerned, he is the father and brother of the said Manjit Singh. It is further submitted that the victim girl has already been married and she is residing in the house of father-in-law.
Patna High Court Cr.Misc. No.20593 of 2015 (2) dt.09-07-2015 2/2 On behalf of the State it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand)each with two sureties of the like amount each to the satisfaction of learned C.J.M., Jehanabad in connection with Makhdumpur P.S.Case No. 177 of 2014 , subject to the conditions as laid down u/s 438(2) Cr.P.C. .
