Petitioner is in custody since 16.03.2016 in connection with Kasba P.S. Case No. 24 of 2016 registered under Sections 302, 201 and 120(B) of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner is not named in the F.I.R. rather the entire F.I.R. has been registered against unknown. Merely on the basis of suspicion, the petitioner has been made accused in this case. The petitioner is rotting in custody for the last 13 months. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner and submitted that the petitioner has confessed his guilt and on whose confession, alleged motorcycle along with SIM

Patna High Court Cr.Misc. No.12336 of 2017 (3) dt.02-05-2017 have been recovered from the field of Manoj Mandal. Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of this petitioner is, hereby, rejected. However, the trial court is directed to expedite the trial and try to conclude the same preferably within a period of six months from the date of receipt or production of the copy of this order.
