Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 324 of the Indian Penal Code. It is alleged that petitioner No. 2 Niraj Pratap Singh @ Chintu Singh assaulted with knife on the head and thereafter with lathi on the hand of the informant. It is alleged against petitioner No. 1 Vinod Kumar Singh @ Bablu Singh that he assaulted with knife on the head of the labour of the informant namely Rudal Singh causing cut injury. It is submitted by learned counsel for the petitioners that one injury of the informant is diffuse swelling of marginal size on right hand caused by hard and blunt substance simple in nature whereas one lacerated wound has been found on the left parietal region of the skull of injured

Patna High Court Cr.Misc. No.22324 of 2015 (2) dt.06-07-2015 2/2 Rudal Singh but the same has been found to have been caused by hard and blunt substance when no injury caused by knife has been found. Moreover there is counter version of the occurrence also, petitioners' side also received grievous injuries and the accusation has been levelled in the background of land dispute.

A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in Raghunathpur P.S. Case No. 122 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
