JUSTICE BIRENDRA KUMAR ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 384/386/307/341/379/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation is that the petitioner and others snatched motorcycle of the informant while the informant was on way.

Submission is that false allegation is there due to political rivalry. Nothing has been recovered from the possession of the petitioner and petitioner has got no criminal antecedent. Petitioner is in custody since 17.01.2017.

Considering the facts aforesaid, let petitioner,

Patna High Court Cr.Misc. No.8624 of 2017 (3) dt.29-03-2017 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra/Successor Court, in connection with Chapra Muffasil P.S. Case No.275 of 2015, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
